Terms of Use

Agreement

These Terms of Use ("Terms") govern your use of the Nopi Fitness mobile application and related services (the "App"), operated by Nopi Studio ("we", "our", or "us"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Who We Are

Nopi Fitness is operated from the Netherlands by Nopi Studio, the trade name of Stijn Verhaar, a sole trader (eenmanszaak) established in the Netherlands.

Eligibility & Minimum Age

You must be at least 13 years old to create an account or use the App. The App is not directed to, and may not be used by, children under 13. By using the App you represent that you are 13 or older. If you are between 13 and the age of legal majority in your country, you may only use the App with the involvement and consent of a parent or legal guardian. If we learn that we have collected personal information from a child under 13, we will delete that information and terminate the account.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. You may delete your account at any time as described in our Privacy Policy.

User Content & Acceptable Use

The App lets you create content — such as workout names and notes, shared activity, profile details, and messages or images you send to the AI coach — and share certain content with friends you connect with. You retain ownership of the content you create. By submitting content, you grant us a limited, non-exclusive license to store, process, and display it as needed to operate the App's features (for example, showing a shared workout to a friend you've accepted).

We have zero tolerance for objectionable content and abusive behavior. You agree that you will not create, upload, share, or transmit any content that:

• is unlawful, harmful, threatening, harassing, abusive, or hateful;
• is defamatory, obscene, pornographic, or otherwise offensive or inappropriate;
• infringes any patent, trademark, copyright, privacy, or other right of any person;
• impersonates any person or misrepresents your affiliation with a person or entity; or
• contains software viruses or any code designed to disrupt or harm the App or other users.

You are solely responsible for the content you create and share.

Reporting, Blocking & Moderation

You can report objectionable content or abusive users, and block other users from interacting with you or seeing your content, directly within the App. We review reports and may remove content, and suspend or terminate accounts, that violate these Terms. We aim to act on reports of objectionable content within 24 hours. You may also contact us at stijn@nopi.studio.

Health & AI Coach Disclaimer

Nopi Fitness is a fitness and wellness tool, not a medical device or a provider of medical advice. Content in the App — including AI coach responses, training plans, calorie estimates, and recommendations — is for general informational and fitness purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any exercise program or if you have a medical condition or injury. You use the App and follow any recommendations at your own risk. The AI coach may produce inaccurate or incomplete information; do not rely on it for medical, emergency, or safety-critical decisions.

Prohibited Conduct

You agree not to misuse the App, including by attempting to access it in an unauthorized manner, interfering with its operation, reverse engineering it, scraping or harvesting data, or using it to violate any applicable law. We may limit, suspend, or terminate your access if you violate these Terms.

Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App, with or without notice, if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitations of liability — will survive.

Disclaimers & Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, Nopi Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App.

Third-Party Services

The App relies on third-party services, including Clerk (authentication) and OpenAI (AI coaching). Your use of the App may also be subject to Apple's applicable terms. We are not responsible for third-party services, and your use of them may be governed by their own terms.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

Governing Law

These Terms and your use of the App are governed by the law of the Netherlands. This does not take away your rights as a consumer: if you are a consumer resident in the European Economic Area or the United Kingdom, you keep the protection of the mandatory consumer protection law of your country of residence, and you may bring proceedings in the courts of that country.
